Presentation: Discrimination Update - Gender Identity and the "New Norm"


It's a rapidly changing landscape with more open acceptance of transgender employees. Many businesses today have already had to deal with new workplace issues involving a transgender worker - or likely will in the near future. An explosion of media coverage and entertainment options spotlighting gender identity have emboldened workers to become more open about their expression and lifestyle. 

 

Gary will cover the legal background on workplace rights based on gender identity, and more recently, sexual orientation. It's been a quick evolution. EEOC, DOL/OFCCP, OSHA and Departments of Justice and Education have led the charge to protect America's workers based on transgender status in only a few short years. How should HR handle a transgender worker's request for accommodation to change his/her name, gender identity or dress/grooming, and how does that fit with your company's culture? And, of course, what about the sensitive issue of bathrooms, locker rooms, and other gender-specific facilities?

 

Gary will also cover the most recent discrimination law developments and trends, the new EEO-1 compensation report, and more.

Gary A. Chamberlin is a member of the Miller Johnson's Grand Rapids office, his employment and labor law practice includes a wealth of experience in employment law representing   employers, as well as in-depth expertise on affirmative action and OFCCP enforcement. Gary’s day-to-day practice involves areas such as advising on employee discipline/discharge, policies and HR practices, medical leave/disability and accommodation management, employment discrimination, labor arbitration and ADR, management/employee training, wage and hour law, and workplace harassment. Gary received his B.S. and an M.L.I.R. from Michigan State University, and a J.D. from DePaul University College of Law. He is a member of the American Bar Association, State Bar of Michigan, Grand Rapids Bar Association, Michigan Council of School Attorneys (former President and Board member) and Association for Human Resource Management (former Programs Director and Board member). Gary frequently presents on a wide variety of employment topics, such as hiring/firing, discrimination laws, drug/alcohol testing, Family and Medical Leave Act, Americans With Disabilities Act, affirmative action and OFCCP compliance, harassment, personnel files/employment recordkeeping and retention, wage and hour laws and privacy issues.
